Terms of Service

Effective April 25, 2026

These Terms of Service ("Terms") govern your access to and use of the WinsAbove platform, websites, and APIs (collectively, the "Service") operated by WinsAbove ("we", "our"). By creating an account or otherwise using the Service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of the information you provide, for safeguarding your credentials, and for all activity that occurs under your account. Notify us immediately at security@winsabove.com of any unauthorized access.

2. The Service

WinsAbove pulls closed-won deal records from connected CRM systems via read-only OAuth, normalizes the data against industry benchmarks, and returns a peer-comparable Alpha Score. The exact methodology is described on the methodology page and may evolve over time as benchmarks and scoring models are refined.

The Alpha Score is a best-effort statistical estimate of relative sales performance. It is not a guarantee of future earnings, employment outcomes, or job offers, and it is not a substitute for a complete hiring evaluation.

3. Acceptable use

You agree not to:

  • Reverse-engineer, scrape, or attempt to extract source data from the Service.
  • Use the Service to impersonate another person or misrepresent your performance.
  • Connect a CRM you are not authorized to access.
  • Resell, sublicense, or republish the Service or its outputs (including Alpha Scores) without prior written consent.
  • Probe, scan, or test the vulnerability of the Service without authorization.
  • Interfere with the Service's availability for other users.

4. Intellectual property

We own the Service, including the platform code, scoring methodology, benchmark distributions, brand, and content (excluding your data and any content you publish on your own profile). You retain ownership of all data you provide or that we read from your CRM on your authorization.

By using the Service, you grant us a limited, revocable license to process your data solely to deliver and improve the Service as described in our privacy policy.

5. Subscriptions, billing, and refunds

Pricing tiers and features are listed on the pricing page. Paid subscriptions auto-renew at the end of each billing cycle until canceled. You can cancel anytime from your dashboard.

First-month refunds on Pro and Teams plans are available, no questions asked. After that, cancellation takes effect at the end of the current billing period and is not pro-rated.

6. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific Alpha Score result will be achieved.

7. Limitation of liability

To the maximum extent permitted by law, WinsAbove and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of your use of the Service. Our aggregate liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars.

8. Indemnification

You agree to indemnify and hold harmless WinsAbove from any claim, liability, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your infringement of any third-party right.

9. Termination

You can terminate your account anytime from your dashboard. We may suspend or terminate your access if we reasonably believe you have violated these Terms. On termination, your access ends and we will delete your data within 30 days, subject to legal retention obligations.

10. Changes to the Terms

We may modify these Terms from time to time. Material changes will be announced by email and on the platform at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction there.
